1. ACCEPTANCE OF TERMS AND CONDITIONS

The terms and conditions are the terms on which Seniors Card Ltd (Seniors Card) offers you a membership to its services and facilities, including its web site. By registering as a member of Seniors Card you accept these terms and conditions. If you do not accept these terms and conditions, you must refrain from using the services.

2. AMENDMENT OF TERMS AND CONDITIONS

These terms and conditions may be amended in whole or in part by Seniors Card from time to time. You are responsible for ensuring you are familiar with the latest terms and conditions and are deemed to have read the latest version of the terms and conditions. Your continued use of Seniors Card represents your agreement to be bound by the terms and conditions as amended.

3. TERMINOLOGY

In these terms and conditions, the following expressions have the meanings set out:

• Advertiser" means any party who advertises goods or services for sale on the Site
• "Member" means a registered member of Seniors Card.
• “Business” and “Businesses” means a registered business of Seniors Card
• "Services" means services offered by Seniors Card from time to time, including forums, message boards, and chat rooms and any other service that Seniors Card may offer.
• "Site" means the website known as Seniors Card.
• "we" , "us" and "our" are a reference to Seniors Card Ltd
• "you" and "your" are a reference to you.

4. THE SERVICES

Seniors Card supplies a card for the use of a member to obtain benefits and discounts from businesses registered with Seniors Card. The amount of discount or type of benefit will be as the business has specified to Seniors Card at the time of their registration.

From time to time Seniors Card may offer products and services for sale to members on behalf of Businesses, Sponsors or other advertisers through the website or newsletters.

5. GENERAL DISCLAIMER

While every effort is made to ensure the Seniors Card offers are accurate and up-to-date, Seniors Card, its staff, contractors and agents do not accept responsibility for any errors, omissions or inaccuracies whatsoever or for changes in the policy of businesses advertised from time to time. Seniors Card does not warrant that the Seniors Card member price on goods or services will always be the lowest price available at the time of purchase or supply. No representation is made as to the suitability for any purpose or the quality of any goods or services offered by participating businesses.

Responsibility for the content of advertisements appearing on this web site (including hyperlinks to advertisers' own websites) rests solely with the advertisers. The placement of such advertisements on the website does not constitute Seniors Card recommendation or endorsement of the advertised product or service. Each advertiser is solely responsible for any representation made in connection with its advertiseme.

6. MEMBERSHIP

You must be aged 55 years or over at the time of applying for a Seniors Card, and must supply your date of birth as part of the application process. Business providers may request additional forms of identification or proof of age from time to time. You will pay a membership fee at the time of application for a Seniors Card. The amount of the fee will depend on the number of years of membership applied for and which may be varied from time to time.

You warrant that you provide complete, accurate and current personal information when registering as a member. You agree to maintain and update your personal information - you must advise Seniors Card if you change address during the period of membership. You are still an (inactive) member once your card has expired.

6.1 MEMBERSHIP CANCELLATION

If you wish to terminate your membership with Seniors Card (and to have your details removed from the database), please write to us at PO Box 38228 Howick Auckland 2145 New Zealand, to confirm.

6.2 CARD DELIVERY

Please allow up to 15 working days for delivery of your card after completing the registration form - on site.

7. GENERAL

The Card is not transferable and remains the property of Seniors Card Ltd. No Refunds on membership are available

A replacement card can be issued if a card is lost or stolen. There may be a charge made.

The member agrees to the disclosure of their information to Seniors Card contractors for the purpose of processing application forms and the mailing of Seniors Card offers and information.

From time to time, we may notify members by email when new and or special announcements are made. Also from time to time Seniors Card registered businesses, sponsors and other advertisers may wish to communicate with our membership. By being a member of Seniors Card you are agreeing to receive both these types of email. Please note: At no time will Seniors Card sell or rent your personal information to a third party. 8. GOVERNING LAW

These terms and conditions are governed by the laws of New Zealand.

9. INTELLECTUAL PROPERTY RIGHTS

Seniors Card (and its sponsors, businesses and suppliers as the case may be) owns all the proprietary and intellectual property rights in the website (including text, graphics, logos and icons) and the software and other material underlying and forming part of the services and the website. You may not without our prior written permission, in any form or by any means: adapt, reproduce, copy, store, distribute, print, display, perform, publish or create derivative works from any part of any Seniors Card publication or the website or commercialise, copy, or on-sell any information, or items obtained from any part of Seniors Cards’ publications or website.

10. ENTIRE AGREEMENT

These terms and conditions supersede all previous conditions, understandings, commitments, agreements and representations whatsoever whether oral or written, and constitutes the entire agreement between the parties relating to the subject matter of these terms and conditions.

11. PRIVACY

Seniors Card collects personal information about you through your use of the services and the website, including your registration details, and information relating to your use of the web site and the content you access. You agree that Seniors Card may use this information to assist us to provide the services to you, for internal research purposes, to verify your identity, for promoting and marketing other Seniors Card products and services to you and for any other use that you authorise. We will not sell or allow third parties to access your personal information without your consent, however you agree that Seniors Card may disclose your personal information, including your name and contact details to the relevant authorities, parties and/or the applicable intellectual property right holders (or their representatives) if we consider that you are in breach of our privacy policy.
